This agreement is jointly entered into by you and the Fei Lai Shuo English operator, Shenzhen Qiwei Tongda E-commerce Co., Ltd. This version is only available to users who are over 14 years old. The collection and disclosure of personal information, as well as the export of personal information, shall be handled according to the corresponding list, independently checked or popped up.

1. Service content and algorithm description

Fei Lai Shuo English provides daily Chinese and English content, audio playback, follow-up recording, real-time pronunciation scoring, learning feedback, check-in and learning maps, points, leaderboard, membership, system tone, dialogue practice, custom scene application, and account management functions, based on the actual display of the current app.

Pronunciation scores, AI feedback, dialogues, and some learning content are generated with the assistance of algorithms or artificial intelligence, and prompted in ways such as "AI generated" or "AI assisted generated". The results are for language learning reference only and do not constitute a basis for exams, employment, further education, or professional certification.

2. Account and age requirements

You should use your legally controlled mobile phone number and SMS verification code in Chinese Mainland to register and log in, properly keep the verification code, equipment and login status, and not rent, lend, transfer or sell your account and rights. Children under the age of 14 are not allowed to register or use this version.

3. Follow reading, cross-border scoring, and AI content

The microphone is only activated when you actively follow along. Only after you request a rating and have given separate cross-border consent, will this recording and English text be transmitted to Microsoft Azure Speech located in the United States for real-time processing through an encrypted connection. We do not save the original recordings on the server, only the ratings, details, and learning records. Refusal or withdrawal does not affect other basic functions, but ratings cannot be used.

4. User Content and Infringement Liability

You are responsible for the nickname, avatar, custom scene description, example sentences, and other content, and ensure that the source is legal and does not infringe on the rights of third parties. You only grant us a non exclusive, free storage, copying, auditing, processing, adaptation, and display license that is necessary to provide the corresponding functionality; When using your avatar, likeness, or content for independent commercial advertising or external promotion, separate authorization must be obtained.

If your content or behavior causes infringement, complaints, claims, penalties or disputes, you shall independently assume responsibility and be responsible for resolving them in accordance with the law; Platform review does not constitute a guarantee of legality.

5. Ranking, Points and Payment

When registering or logging in, you need to independently read and agree to the Personal Information Collection List. After agreement, those who have reached the rule score will have their nickname, avatar, member ID, highest score, ranking, and number of likes publicly displayed to other logged in users on the "Today's Score List". Their phone number, original recording, and complete rating details will not be disclosed. You can withdraw it in your privacy settings; I agree again that I need to log in again.

Points and supplementary cards are only for use within the app according to the rules and do not have cash value. The price, benefits, term, renewal, upgrade, recovery and refund of members shall be subject to the relevant rules of the purchase page, Apple App Store or Alipay.

6. User behavior and intellectual property

You are not allowed to use this service to engage in illegal or irregular activities, attack, interfere with, or damage the service system, or impersonate others or infringe on their legitimate rights and interests; Do not steal, leak, transfer, abuse, tamper with or destroy account data, learning data, voice data, role data, trade secrets or other information; Unauthorized resale, rental, lending, distribution, or commercial use of this service is prohibited.

The software, interface, logo, text, audio, images, algorithms, and platform content of Fei Lai Shuo English are legally owned by us or the corresponding rights holders. Normal use does not transfer any rights to you.

7. Disclaimer and Responsibility

We will reasonably ensure the security and stability of our services, but we do not guarantee that the services will never be interrupted, the results will be absolutely accurate, or fully meet specific expectations.

If you violate laws and regulations, this agreement or platform rules, or if your content infringes on the rights of third parties and directly causes losses to us, our affiliates or partners, you shall bear corresponding responsibilities and compensate for actual, direct, reasonable and evidence-based losses, as well as compensation or settlement expenses, administrative penalties and reasonable lawyer fees, litigation fees, arbitration fees, notarization fees, appraisal fees, preservation fees, evidence collection fees and execution fees that have a direct causal relationship with the behavior. Except for those caused by our intentional or gross negligence; The liability that cannot be excluded or limited by mandatory legal provisions shall not be affected.

8. Cancellation, Update, and Dispute Resolution

You can apply for cancellation within the app and verify it through SMS. After cancellation, the account and most of the personal information will be deleted or anonymized; Information that must be retained according to law will be isolated and stored within the statutory period. Major agreement updates will be prominently indicated and require re agreement.

This agreement is governed by the laws of the People's Republic of China. Disputes should be resolved through friendly negotiations first; If the negotiation fails, a lawsuit shall be filed with the people's court that has jurisdiction according to law.
